TN Visa for Canadian and Mexican Professionals Under USMCA

The TN visa is a special non-immigrant work visa available to Canadian and Mexican professionals under the United States-Mexico-Canada Agreement (USMCA, formerly NAFTA). It is one of the most straightforward U.S. work visa pathways for eligible citizens.

Who Qualifies

  • Citizens of Canada or Mexico (permanent residents do not qualify)
  • Coming to work in one of the USMCA-listed professional occupations

Application Process

For Canadian Citizens

  4. Pay the CBP fee and receive TN status if approved.

For Mexican Citizens

  1. Obtain the same job offer package.
  2. Apply for a TN visa at a U.S. consulate in Mexico.
  3. Attend a visa interview.
  4. Enter the United States with the approved TN visa.

Duration and Renewal

TN status is granted for up to three years and can be renewed indefinitely, as long as the underlying employment remains temporary in nature.

Advantages

  • No annual cap or lottery
  • Faster and less expensive than H-1B
  • Spouses and children can accompany on TD status

Limitations

  • TN is temporary — it does not provide direct dual intent for green card pursuits
  • TD spouses cannot work in the U.S.
  • Only listed occupations qualify; job duties must clearly match
